The people of Jalingo-Maiha district wondered why should people that have no any connection with the district or the people interfere in the affairs of the monarchy if not to instigate acrimony for anarchy, while they sit at the distance in their various comfort zone districts, like a spider in the proverbial African folktale, happily clapping and laughing over the destructions to end the district they machinated.
The exasperated subjects as electorates expressed dismay over perceived interference in the affairs of their district, seeking to know if the so-called aliens have any political relevance in Jalingo-Maiha.
“They don’t advise the Chief Executive of the state to bring any developmental project or programme to Jalingo-Maiha district or Maiha local government as a whole. No! This one is for the district they hold tenacious as indigens. They only use their seeming poisonous sentiment for advice to smear an established monarchical order with hatred,” the sage would say.
“Affirming the High Court ruling, the Appeal Court has been explicit in directing the Adamawa State Governor to approve the appointment of The heir to the stool as the legitimate district head of Jalingo-Maiha.
“The judgement is explicit that only those with ulterior motives against the peaceful coexistence in the community will have contrary understanding, Satanic, cultist and devilish in nature, so intolerable to every revealed religion and culture.
“The conspirators will want the people loose confidence in governance and on the governor by advising him against the law, on monarchy in Jalingo-Maiha district. The governor must ignore the politically irresponsible and irrelevant elements bend on bewitching good conscience and do the needful,” the sage will say.
It is not clear what informed the sage’s projection, as the judgement has already been declared and the governor’s only option is to honour the court judgement for which the people of Jalingo-Maiha are patiently waiting.
For the record, the High Court has delivered in part, the following declarative judgement:
“1. That the approval of the 3rd defendant (Idi Usman Shehu) by the Governor of Adamawa State as the District Head of Jalingo-Maiha District, Maiha Local Government Area, who was not the person recommended by the 2nd Defendant (Mubi Emirate Council), is wrongful, illegal, null and void.
“2. That the plaintiff (Mahmud Abubakar Sulaiman) whose name was forwarded to the Governor of Adamawa State for approval by the 2nd Defendant, is the proper person to be approved for appointment as the District Head of Jalingo-Maiha District.
“3. It is hereby ordered that the Governor of Adamawa State (1st Defendant), should approve the plaintiff (Mahmud Abubakar Sulaiman) as the proper person for appointment as the District Head of Jalingo-Maiha District, Maiha Local Government Area.
“4. An order of perpetual injunction is hereby given, restraining the 3rd Defendant (Idi Usman Shehu) from parading himself as the District Head of Jalingo-Maiha District, Maiha Local Government Area of Adamawa State.”
The judgement is simply summarily explicit. It gives no room for parabolic or abstract, prone to defective or misleading interpretation.
The judgement as pased was in total consideration of the procedures for the appointment of the district head of any of the districts in Adamawa state are statutorily delineated under section 7 of the Adamawa State District Creation Law, 1992 (as amended), herein after referred to as “the applicable law”. Same provides this:
“7(1) The procedures for the appointment of the district head shall be in the following manner where traditional or customary methods of selection or District Head exist.
(a) Selection shall be done in accordance with tradition and custom of the area consisting the District and under security agents as the Council may require.
(b) The representative of the Council shall within one week make a report in writing to the Council of the result of the selection and submit same indicating the first three names who have the required number of votes set down by the Council.
(c) On receipt of the report, the council shall deliberate on the report and shall recommend one person to the governor for approval as the District Head of the District concerned.
(d) the Council shall within one month of the approval take necessary steps to perform Turbaning Ceremony.
Subsection (c) has said it all; irrespective of scores, three persons with the highest votes shall be subjected to selection of one candidate to be recommended to the governor by the Emirate Council.
