The appeal court sitting in Yola, Adamawa state, northeast Nigeria, has fixed tomorrow, being Friday, September 25, 2020 for passing of judgement on the legitimacy to the monarchy in Jalingo-Maiha district, Maiha local government, northern senatorial district, Adamawa state.
The third defendant; Idi Usman Shehu, whom the first defendant; the former Adamawa state governor Bindow appointed as district head, against the selection and submission by the Mubi Emirate Council being the second defendant, of the legitimate candidate – Barr. Mahmud Suleiman Abubakar, the heir to the late district head, has challenged the ruling of the Yola High Court that restrained him from parading himself as district head of Jalingo-Maiha for apparently not sharing legitimate lineage, kith and kinship and ordered the Adamawa governor to approve the plaintiff – Barr. Mahmud as the legitimate district head, before the court of appeal.
The High court order in part, issued the following declarations for which the former governor Bindow failed to honour even though it was a declarative judgement:
* That the approval of the 3rd defendant by the Governor of Adamawa State as the District Head of Jalingo-Maiha District, Maiha Local Government Area, who was not the person recommended by the 2nd Defendant, is wrongful, illegal, null and void.
* That the plaintiff whose name was forwarded to the Governor of Adamawa State for approval by the 2nd Defendant, is the proper person to be approved for appointment as the District Head of Jalingo-Maiha District.
* It is hereby ordered that the Governor of Adamawa State (1st Defendant), should approve the plaintiff as the proper person for appointment as the District Head of Jalingo-Maiha District, Maiha Local Government Area.
*An order of perpetual injunction is hereby given, restraining the 3rd Defendant from parading himself as the District Head of Jalingo-Maiha District, Maiha Local Government Area of Adamawa State.
The third defendant – Idi Usman Shehu has challenged the high court judgment before the court appeal while he continued his seeming overambitious romance with the contempt of court and executive orders, until the present governor, in tune with the court order, restrained by banning him from Jalingo-Maiha but suspended the approval of the appointment of Barr Mahmud until after the determination of the court of appeal.
To be able to partially mend the crack wall that allowed a wall gecko creeping in to venomously infest the monarchy in Jalingo-Maiha, the Mubi Emirate Council found it fitting to appoint an acting district head who was prophesied would peacefully handover the stool to a heir to late district head.
The acting district head, Muhammadu Dalil is a man so dear to peace, law and order in addition to being faithful to the faith he professed and the assignment he is tasked to accomplish.
Dalil is quoted to have said that he was not in Jalingo-Maiha to takeover but to handover to the God destined not district head; To be able to accomplish the task, he called on the community to join him in prayers that would destroy any form of conspiracy against the monarchy and send away the hypocrites out of Jalingo-Maiha.
Tomorrow’s judgement, the sage would articulate, ending hypocrisy, complicity to conspiracy for anarchy, wearing the face of tyranny and near apostasy, against the monarchy in Jalingo-Maiha district, would open a new book but that which would continue by linking to the real root, defining the legitimacy from where the late district head has had his monarchical task terminated.
