It is now over 14 days when the Adamawa State Governor was served a court notice of judgement; an order of mandatory injunction compelling him as a Governor to approve the appointment of Mahmud Abubakar as the legitimate District Head of Jalingo-Maiha District.
The same notice was communicated to the Emirate Council for information and action, hence it would amount to contempt of court order for any recognition of an interim or acting district head in Jalingo-Maiha.
However, the order of mandatory injunction is not honored to this day. The acting district head reigned in Jalingo-Maiha throughout the Eid-El-Kabir festive period as he reigns to this day.
The electorates begin to wonder where lies the independence of the judiciary and the capacity to interpret the law for the executive to enforce it.
“Why is the Adamawa State Governor so much against the monarchy and the nobility in Jalingo-Maiha to have warranted undue delay in the approval of the appointment of the court declared, Emirate Council selected district head, typical of denial of the legitimacy of the district headship and what next?
“It is not just a court and a judge but the Chief Judge of Adamawa State that has passed the judgement, which is in line with the earlier high court and the appeal court judgements. So why is the executive undue delay in adhering to the court order and by implication, the rule of law?” The electorates I. Jalingo-Maiha keep asking
“This is not a worthy precedent, going against, by being above the law, as it would make the citizenry to believe that the state is without justice, without a law, hence the aggrieved would resolve to taking the law into own hands, which is defined as anarchy that is not prayed for.
“Jalingo-Maiha is peaceful with peace living, peace loving people, rather than taking the path of violence, the ruling family opted to resolve the monarchical differences before the law. If any person, group or institution would discourage the law-abiding citizens from the Judiciary in general and the justice with the courts of law in particular, it shouldn’t be a chief executive of the state,” the electorates would argue.
The court order read thus:
“In the High Court of Justice of Adamawa State of Nigeria in the Yola Judicial Division Holden At Yola Before His Lordship Hon Justice Nathan Musa (Chief Judge) This 15th Day Of June, 2022
