…Will Governor Fintiri honour Courts orders in the case of Pakka District Headship? Will it suffer the executive denial by means of delay as in the case of Jalingo-Maiha?
Another judicial blow on the Adamawa state governor as a High Court in Yola presided by Justice Musa Usman has on Monday, 12th September, 2022, voided the appointment of the District Head of Pakka, said to be speedily made by the State Governor.
The court has in the judgement, ordered the Mubi Emirate Council to conduct fresh selection with immediate effect.
A contestant, Mohammed Ali Ardo (Plaintiff) has dragged the Mubi Emirate Council, 3 others and Attorney General of the state as 1st, 2nd, 3rd and 4th defendants, respectively, over the selection process and appointment of Mohammed Abubakar as the district head of Pakka in Maiha Local Government Area.
In his Judgment, Justice Musa, said the plaintiff has been disenfranchised by being denied to cast his vote during the selection exercise under the supervision of representatives of the Mubi Emirate Council.
That the exclusion of the 1st plaintiff from participating in the selection exercise conducted on the 17th of November, 2021 by the 4th defendant in the 1st plaintiff Capacity as the village head of Pakka for the purpose of determining candidate to be recommended to the Governor of Adamawa State for approval for appointment in to the office of district head of Pakka as provided by section 7 (2) (a) of Adamawa State creation of district law is a violation of the 1st plaintiff right and a flagrant abuse of power by the 4th defendant.
That the act of the 4th defendant in excluding the 1st plaintiff from participating in the exercise conducted by the 4th defendant on the 17th November, 2021 has directly or indirectly jeopardized his right to be a person qualified to be recommended by the governor of Adamawa State for appointment to the office of the district head of Pakka.
That the exclusion of the 1st plaintiff by 4th defendant in the manner aforesaid on the 17th days of November, 2021 is a violation of the procedure laid down for setting in motion the process that would culminate in the eventual appointment of district head of Pakka particularly in the light of the section 7 (2) (b) of the Adamawa State creation of district law 1992 as amended and consequently null and void and no effect whatsoever.
That the exercise conducted by the 4th defendant on 17th November, 2021 with a view to appoint a new district head of Pakka is hereby set aside.
The 4th defendant is directed to conduct a fresh exercise for said purpose and the 1st plaintiff must be allowed to participate.
It should be noted that the plaintiff is a brother to the immediate past chairman of Maiha local government, Hon Idi Aliyu Aminu, the Rumbun Adamawa.
Rumbun Adamawa has in an interview with the newsmen previously, accused governor Fintiri of partiality and dishonoring court orders by failing to approve the appointment of Barr Mahmud Abubakar as the district head of Jalingo-Maiha.
