The people of Jalingo-Maiha District, the headquarters of Maiha local government and indeed the people of Mubi, said to be the headquarters of the northern senatorial district of Adamawa state, northeast Nigeria, nursing the spirit of justice and fairness for the greatest good of the state and restoration of confidence in governance, are in collective lament that just like 2021, year 2022 has ended and the year 2023 has just entered, “marking a new beginning with yet district head palace still remains unoccupied.
The Periscope Global has in January 1, 2022 edition reported that “the to have been vacancy has since been declared legally occupied by the legitimate heir in concord with the Emirate Council’s selection.
“The judgement passed by a Yola high court over three years ago, has declared Barr Mahmud Abubakar as the legitimate district head of Jalingo-Maiha.
“The determination of the court of appeal has over a year ago upheld the high court judgement, which orders the state governor to approve the appointment of the Emirate Council selected district head, the concerned youth of Jalingo-Maiha could not however fathom the reason behind the executive delay in the implementation of the court order years after judgement.
“The opponent to justice, whom the law humiliated, are however jubilating the executive delay of the approval of the district head appointment. They are insinuating that the courts have their say and the chief executive has his ‘nay’ way”.
“Constitutional and human right lawyers in Lagos, Kano and Abuja, having considered as aberration the undue executive delay in the approval of appointment, pointed out that the declared district head could go back to court and seek for an order of enforcement.
“We’ve keenly observed the development being reported by the Periscope. The executive denial by means of delay in honouring courts order is inimical to rule of law, fundamental human right and democracy.
“According to the concerned youth, “Democracy hasn’t been taken into consideration by the state executive arm in the issue of district head of Jalingo-Maiha, by undermining the rule of law, equality before the law and fundamental human right.
“Has Jalingo-Maiha and/or the ruling family, in any way offended and/or offend(s) the state or the governor(s) to have warranted such treatment?
“Is the governor reserving the approval of appointment of our district head, even if not till kingdom come, till electioneering period?”
“Speaking with the aristocracy of Maiha, faith in fate with patience and perseverance took the central theme.
” The aristocracy would philosophise that there is time in and for everything. The former governor has translated his thought, deploying executive muscles against the legitimate ruling family in Jalingo-Maiha. His action by whatever intention is reversed before the law even before the termination of his tenure never to be renewed by the electorates.
“Year 2021 has just ended, year 2022 is just beginning, Jalingo-Maiha district head palace remains unoccupied, with the speed of light the passing time, could the patience be extended to year 2023?
“The bottomline is that the delay shall come to pass, time shall soon tell in God’s name, the aristocracy would articulate”.
As projected, the delay in the approval of the appointment of the District Head of Jalingo-Maiha has entered 2023 and even with the court order mandating the state governor to do the legally required.
